Is Singapore a state of the USA?

The media has reported widely about the corruption case involving Keppel O&M and a Brazilian company. And somehow the US Justice Dept is the authority on this case as if it has jurisdiction over Keppel O&M operating in Brazil or jurisdiction over commercial crimes in Brazil. Below are some details of the case posted by Kenneth Jeyaretnam in TRE.
 

‘Quietly over Christmas the US Justice Department announced that it had reached a deferred prosecution agreement with Keppel Offshore and Marine. Under the agreement Keppel O & M, a unit of Keppel Corp, will pay $422 million to resolve charges that it paid $55 million in bribes to Brazilian politicians to win business from the state oil company Petrobras, an offence under the US Foreign Corrupt Practices Act.
 

According to the WSJ, “Keppel admitted in court documents that it paid about $55 million in bribes to officials at Brazilian state-owned oil company PetrĂ³leo Brasileiro and the then-governing party in Brazil from 2001 to 2014 to win 13 contracts with Petrobras, as the company is also known, and another company. It paid the bribes through outsize commissions to an intermediary, who in turn made payments to the officials and the political party, prosecutors said.”’
 

Keppel O&M committed an offence under the US Foreign Corrupt Practices Act? OK, one of the parties involved in the corruption is a US citizen. This person could be charged under US law. Does this mean that Keppel O&M, a Singaporean company operating, maybe registered in Brazil would also come under an American Law, governed by an American Law? How could this be? How could this happen? Is Singapore or Brazil a subject member of the American Empire that an American Law can be applied over them?
 

I can’t believe this. This is just like the Americans legislating a law to conduct relations with Taiwan and telling China to obey and respect this American Law. Like that the Americans can fabricate all kinds of laws to govern all the countries in the world.
 

Can other countries also legislate laws to govern citizens and organisations of other countries including American citizens and corporations? Can China, Russia or Singapore come out with their own Foreign corrupt Practices Act to apply to everyone, including Americans?
 

If the crime of Keppel O&M were committed in US territory, there is no question about US jurisdiction. This offence was committed in Brazil, why would Keppel O&M subject itself to American laws and sheepishly and willingly admit to the crime, accept the fines of an American court?
 

I don’t see why Keppel O&M should submit itself to American jurisdiction, to be judged by the American courts, with no objection, no protest as if this is a right and normal thing to do, and so happy about it. Are Singaporeans subjects of the American Empire?
 

The American Empire rules! Singapore has to accept the rule of the American Empire? Singapore and Brazil are sovereign states, not states within the USA.

This Kopple case involved a US citizen Jef Chow, he is sinkie PR working in Kopple legal for 25 yrs, a US subsidiary not reported in Reuters.

Chow owned up the scheme. Over payment to facilitate the excess money to be used for bribery. Chow admitted he knew the over payment. (this kind of payment involves millions dollars, how can the senior managment dont know? as authorizing payment has level of authority. Million dollars needs to be signed by whom?)

It was "a deal" between the "authorities" of the 3 countries. The US subsidiary pleaded guilty for an amnesty called deferred prosecution.

The sinkie deal was supper good. according to report gained $351.8, fined by US $422, both in millions. So u know what is the story now.

In the Keppel O&M corruption case, Sinkieland under the ruling party PAP chose to submit to American Laws. Why they chose to submit? For their own good reasons lah.

Why must Keppel be subjected to the US Prosecutors' demand?

Irrespective of whether Keppel has committed any corruption, it is none of the US DOJ's business. It is between Singapore Government and the Brazilian Government to tackle the case.

Bloomberg reported that the Keppel O&M corruption probe has concluded with the payment of a record S$567 million dollar fine.

"About a quarter of the fine will be paid to the Singapore government and “These payments were part of the total criminal fine“.

Singapore CNA's report was only referring to the US$53 million fine which will be paid within 90 days and a further US$53 million within 3 years by Keppel O&M.

This shows that LHL's government stands to gain from the criminal acts of senior GLC executives, is it not?

According to Independent, the 5 senior management executives of Keppel involved in this corruption case are:

1. Choo Chiau Beng, former CEO of Keppel Corp and former CEO of Keppel O&M.

2. Chow Yew Yuen, former CEO of Keppel O&M.

3. Tay Kim Hock, former CEO of Keppel Fels Brasil.

4. Kwok Kai Choong, current CEO at Keppel Fels Brasil.

5. Tong Chong Heong, former Senior Executive at Keppel Corp.

According to Court Testimony by Mr Skornicki, Keppel’s agent, “he was given enough autonomy to sign contracts with Petrobras on behalf of Keppel“. He also used “the same accounts where Keppel paid him his formal fee to then bribe officials“.

According to him, "Keppel senior management had full knowledge and condoned his corrupt acts."

However, it appears that no further action will be taken against the 5 Keppel Executives as they have already been issued a “conditional warning” by AGC.

According to High Court Justice Woo Bih Li, a “warning” by the AGC is “no more than an expression of the opinion of the relevant authority that the recipient has committed an offence”.

Although Keppel’s corruption case has tarnished Singapore's good image and world reputation, as well as a total disgrace for our GLCs, Chairman Lee Boon Yang indicated that he was only “deeply disappointed”.

According to Keppel, Chairman Lee Boon Yang was paid S$675,000 in 2016 – because of “the greater responsibility carried by that office.

Shouldn't Lee Boon Yang now shoulder this greater responsibility by absobing all blames and resign or be kicked out in disgrace?

Why are the shareholders so quiet?
Why is the CPIB not take the initiative to investigate further into what other corrupt practices that Keppel as a whole have been practicing for the last 20 years?

Meanwhile, fresh court documents out on Tuesday US time revealed that a former Keppel O&M lawyer had pleaded guilty and cooperated with the US authorities.

Jeffrey Chow, a former senior member of Keppel O&M's legal department, cut a deal with prosecutors, said a Reuters report, citing documents unsealed in federal court in Brooklyn.

Chow, 59, pleaded guilty on Aug 29 to conspiring to violate the Foreign Corrupt Practices Act, and admitted to drafting contracts that were used to make bribe payments, said the court records.

"I am deeply sorry for my conduct," he said during his plea hearing, according to a transcript.

He said he drafted contracts with a Keppel agent in Brazil who he realised was being overpaid by millions of dollars so he could bribe Brazilian officials.

"I should have refused to draft the contract that we used for paying bribes and I should have resigned from Keppel," he said.

Court records state that Chow, a US citizen, has a residence in Singapore and had worked for Keppel for more than 25 years. He is scheduled to be sentenced on May 2.

On Friday (Dec 29), the party's assistant secretary-general Pritam Singh wrote on Facebook that he, as well as fellow MPs Sylvia Lim and Png Eng Huat, had collectively filed four questions relating to the incident.
"Amidst the shocking revelation of what must be one of the largest corruption scandals in the history of Singapore's Government-linked Companies, I was most surprised to see the virtual absence of any substantive information on this scandal on the AGC or CPIB websites except a brief media statement on the conditional warning given to Keppel," he said.

It was "even more curious" since the company denied its top executives were involved in giving out bribes for contracts, he added. He noted that the US Department of Justice had uploaded documents on the case to its website.

The questions filed by Mr Singh to Finance Minister Heng Swee Keat relate to issues such as when the Government expects CPIB and the Attorney-General's Chambers (AGC) to formally complete investigations into the Singaporean individuals involved, as well as how many Singapore Government-linked companies or their subsidiaries have been or are investigated for corrupt practices over the last 30 years.

Ms Lim asked if the fines paid were part of a three-nation plea bargain agreement involving the US, Brazil and Singapore, and if it is, what are the considerations in reaching such agreements, while Mr Png asked how far back will CPIB go in its investigations since the corrupt practices date back to 2001.

Every big organisations would have a set of procedures on corporate authority level to sign off with monetary value for each level of executive. For sums involving millions or hundreds of millions, the minimum level must be the Chairman and with approval from the Board of Directors. CEOs are unlikely to be given such sweeping power to authorise millions of dollars of transaction or sign cheques for payment.

If cheques or payments of such huge amounts were signed off without proper authorisation, the persons signing the cheques would have violated their authority and committed an offence. Banks would not honour cheques from individuals that do not have the authority to do so. Following the trail of the cheques would reveal all the misdeeds and wrong doings and by who and who.

Rb, mainly due to petrol dollar and global use of us$ as reserve and international transactions going through the USA financial system via the USA for settlement of us$. So Keppel has no choice cause if Keppel refused to pay, it will be locked out of us$ which is not possible then for Keppel to operate. As Long as us$ is used in global trade and use as reserve, all countries are under USA jurisdiction.

Since the allegations emerged, we have moved quickly and decisively to put in place stricter controls and embedded best practices across the Group to ensure that such unacceptable behavior will not be repeated.”


The facts revealed so are:

1. Jeffrey Chow, 59, a former senior member of Keppel O&M's legal department, cut a deal with prosecutors, and pleaded guilty on Aug 29 to conspiring to violate the Foreign Corrupt Practices Act, and admitted to drafting contracts that were used to make bribe payments.

2. He had drafted contracts with a Keppel agent in Brazil who he realised was being overpaid by millions of dollars so he could bribe Brazilian officials.

3. Jeffrey Chow, a US citizen, has a residence in Singapore and had worked for Keppel for more than 25 years.

4. The shady deals jave been going on from 2001 to 2014. During all these 13 years, can anyone believe that the Board of Directors of Keppel have been sleeping on their collective and individual responsibilities and knew nothing about the movements of hundreds of millions of dollars being paid as bribes? Who signed to authorise these transactions? Board of Directors' meetings over the last 13 to 16 years have never reported any movement of huge sims of money overseas, through third parties?

Come on, intelligent people cannot be easily fooled, can they?

I think from this Keppel Corruption Case (giving $50 million bribes to gain contract with a profit of $350 million) for over 13 years (2001 to 2014), there are probably many other cases over the last 20 years.

Also what about other companies under Temasek Holdings?

How many of them could probably have been practicing the same method of getting contracts by giving bribes over the last 20 years, since Ho Ching took over as Executve Chairman and CEO (dual-power posts)?

Looks like giving bribes to get contracts has been the main modus operandi not only in Keppel. Could also have happened in NOL? SG Technology? SIA? DBS? Etc.???

I have now begin to suspect so. Most probably I am correct. But how can we ever know the Truth?

Unless there are insiders willing to leak out information to the public. But if they are well taken care of with monetary rewards, why should they want to whistle-blow?
